These Terms of Use ("Terms") govern your access to and use of Hi Energy Club services, platforms, events (including in-person and online gatherings), and products. By accessing or using Hi Energy Club, you agree to these Terms.

The names "Hi Energy," "Hi Energy Club," and "Hi Energy Social Club" are used interchangeably in these Terms.

If you do not agree, please do not use our services.

1. Who We Are

Hi Energy Club is a brand and operating project of LastDream Labs LLC ("Company," "we," "us," or "our"). These Terms also apply when we refer to Hi Energy or Hi Energy Social Club.

These Terms apply to all Hi Energy Club websites, applications, events, and related services operated by LastDream Labs LLC.

2. Eligibility

You must be at least 18 years old to use Hi Energy Club services unless explicitly stated otherwise for a specific event.

By using our services, you confirm that:

  • You are legally able to enter into these Terms
  • Any information you provide is accurate and truthful

3. Account Registration and Access

Some features require you to create an account using third-party authentication (such as Google or Apple).

You are responsible for:

  • Maintaining the security of your account
  • All activity that occurs under your account
  • Promptly notifying us of unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Events and Participation

A. General Participation

Hi Energy Club events are designed to be inclusive, respectful, and low-pressure. By attending, you agree to:

Events may be in-person or online, and participation expectations apply to both formats.

  • Respect other participants’ boundaries and energy
  • Follow host instructions and event guidelines
  • Behave in a manner that does not disrupt or diminish the experience of others

We reserve the right to refuse entry or remove participants for behavior that is unsafe, disruptive, or inappropriate.

B. Assumption of Risk

Many Hi Energy Club events involve physical activity (including walking, running, yoga, or movement-based gatherings). By participating, you acknowledge and accept that:

  • Physical activity carries inherent risks
  • You are responsible for assessing your own physical condition
  • You participate voluntarily and at your own risk

Hi Energy Club does not provide medical advice and is not responsible for injuries resulting from participation, except where required by law.

5. Purchases, Payments, and Refunds

A. Payments

Payments for events, daily passes, merchandise, or memberships are processed through third-party payment providers (such as Stripe).

By making a purchase, you agree to:

  • Provide accurate payment information
  • Pay all applicable fees and taxes

B. Daily Passes and Event Access

Daily passes may include event access and selected items (such as water, towels, or prize eligibility). Access and inclusions are valid only for the specified event or date.

C. Refunds

Refund policies may vary by product or event and will be disclosed at the time of purchase.

Unless otherwise stated:

  • Event purchases are non-refundable
  • Merchandise refunds follow standard return policies

We reserve the right to issue refunds or credits at our discretion.

6. Event Entry and Prize Eligibility

For certain events, participants may be asked to provide:

  • A display name
  • A secret phrase used for prize verification

You are responsible for:

  • Keeping your secret phrase private
  • Providing accurate information

Prize eligibility may be forfeited if verification cannot be completed.

7. AI-Assisted Features

Hi Energy Club may offer optional AI-powered tools to assist with social interaction or event participation. By using these features, you acknowledge that:

  • AI-generated content is provided for convenience and inspiration only
  • Outputs may be imperfect or incomplete
  • You remain responsible for how you use AI-generated suggestions

We reserve the right to modify, suspend, or discontinue AI features at any time.

8. Community Conduct

Hi Energy Club is built on respect, presence, and shared space.

You agree not to:

  • Harass, intimidate, or discriminate against others
  • Engage in unsafe or disruptive behavior
  • Use the platform or events for unauthorized commercial purposes
  • Misrepresent your identity or intentions

Violation of these principles may result in removal from events or termination of access.

9. Intellectual Property

All content, branding, designs, text, graphics, and materials associated with Hi Energy Club are owned by or licensed to LastDream Labs LLC.

You may not:

  • Copy, modify, or distribute content without permission
  • Use Hi Energy Club branding for unauthorized purposes

Limited personal, non-commercial use is permitted.

10. Third-Party Services

Our services may integrate with third-party platforms (such as payment processors, authentication providers, or AI services). We are not responsible for the content, policies, or practices of third parties. Your use of third-party services is governed by their respective terms.

11. Termination

We reserve the right to suspend or terminate access to Hi Energy Club services at any time, with or without notice, for violations of these Terms or for operational reasons. You may stop using our services at any time.

12. Disclaimer of Warranties

Hi Energy Club services are provided "as is" and "as available."

We make no warranties regarding:

  • Availability or uninterrupted access
  • Accuracy of content
  • Suitability of events or services for your specific needs

13. Limitation of Liability

To the fullest extent permitted by law, LastDream Labs LLC shall not be liable for:

  • Personal injury, property damage, or loss arising from participation in events
  • Indirect, incidental, or consequential damages
  • Loss of data or business opportunities

Some jurisdictions do not allow certain limitations, so this may not apply to you in full.

14. Indemnification

You agree to indemnify and hold harmless LastDream Labs LLC from claims arising out of:

  • Your use of Hi Energy Club services
  • Your violation of these Terms
  • Your conduct at events

15. Governing Law

These Terms are governed by the laws of the jurisdiction in which LastDream Labs LLC is registered, without regard to conflict-of-law principles.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of Hi Energy Club after updates constitutes acceptance of the revised Terms.
